Reporting Copyright, Trademark, and Rights of Publicity Infringement

Photobucket's Intellectual Property Policy covers how you can request the removal of content that infringes your copyright, trademark, or right of publicity, even if you found it somewhere other than Photobucket. 

If the infringing image is actually hosted on Photobucket but embedded or linked from another site, right-click the image, copy its location (URL), and include that URL in your report.

Here's how to report each type:

Reporting copyright infringement

Photobucket takes claims of copyright infringement seriously and will respond to notices that comply with applicable law under the Digital Millennium Copyright Act (DMCA), 17 U.S.C. § 512. To be effective, your written notice must include substantially all of the following:

  1. Your physical or electronic signature, or the signature of a person authorized to act on behalf of the copyright owner.
  2. Identification of the copyrighted work you believe has been infringed, or if the claim involves multiple works, a representative list of such works.
  3. Identification of the material you believe to be infringing, in a sufficiently precise manner to allow us to locate it, including at a minimum the URL or other specific location where the material may be found.
  4. Adequate information by which we can contact you, including your name, postal address, telephone number, and, if available, email address.
  5. A statement that you have a good faith belief that the use of the copyrighted material is not authorized by the copyright owner, its agent, or the law.
  6. A statement that the information in the notice is accurate.
  7. A statement, under penalty of perjury, that you are authorized to act on behalf of the copyright owner.

Important: If your notice doesn't comply with all requirements of 17 U.S.C. § 512(c)(3), it may not be effective. If you knowingly misrepresent that content infringes your copyright, you may be held liable for damages, including costs and attorneys' fees, under 17 U.S.C. § 512(f).

Reporting trademark infringement

If you believe your trademark is being used on our site in a way that infringes your rights, your written notice must include the following:

  1. Your physical or electronic signature, or the signature of someone authorized to act on your behalf.
  2. Contact information sufficient for us to reach you or your authorized agent, including your name, address, telephone number, and email address.
  3. Identification of the trademark, including a copy of your federal or applicable trademark registration certificate (for registered marks), or evidence establishing the time period and geographic area of use (for common law marks).
  4. Information sufficient to identify the specific use being challenged, including the URL or location of the content in question.
  5. A statement that you haven't authorized the use and have a good faith belief that it isn't otherwise authorized by law.
  6. A statement, under penalty of perjury, that the information in the notice is accurate and that you're the trademark owner or authorized to act on their behalf.

Reporting rights of publicity violation

If you believe someone's name, photo, signature, voice, or likeness is being used on our site without permission, your written notice must include the following:

  1. Information sufficient to identify the content at issue, including its URL or location.
  2. Your name, address, telephone number, and, if available, email address.
  3. A statement that you, or if you're a parent or legal guardian acting on behalf of a minor, have not authorized the use, and that the use isn't otherwise authorized by law.
  4. A statement, under penalty of perjury, that the information in the notice is accurate and that you're the person whose likeness is at issue, or are authorized to act on their behalf.
